Member's/User’s Responsibility
It is important to note that if a Zeta member is found to be violating the law or Zeta rules, such as over speeding or driving under the influence of alcohol, the member will be held responsible for any resulting damage, liability, fines, and may also face legal action.
Toll:
Please note the following important points regarding tolls, vehicle permits, and inter-state taxes:
1. Members are responsible for promptly paying all tolls as they become due during their journeys. This ensures smooth passage and compliance with regulatory requirements.
2. Zeta vehicles has the vehicles of the partner who have attached their car on Zeta Platform, so there is no such requirement for All India Permit, hence vehicle are allowed to enter any state within the country. This permits our members to travel freely and conveniently across state borders without any restrictions.
3. Upon entering a neighboring state, members are required to pay all inter-state taxes and fees as applicable. This is essential to fulfill legal obligations and maintain compliance with inter-state regulations.
By becoming a member of Zeta, you agree to pay the costs, charges, fees, and expenses outlinedin the Agreement, including those specified in this schedule. Please note that this list is not exhaustive, and there may be additional fees and charges that apply. Zeta will communicate any other applicable costs to you.
Zeta reserves the right to modify the terms of this Policy, and we will notify you of any changes in a timely manner. Notice will be considered given when it is indicated and accessible from the first page you see after logging into the Zeta website or through an email sent to the email address provided in your application or the most recent one you provided to Zeta.
You agree that the revised terms and conditions of the Agreement will be effective and binding either on the date specified in the notice or on the date posted on Zeta’s website, whichever is earlier.
Collision or other incident:
Please note the following important points regarding member responsibilities and charges:
1. In the event of an unintentional/non-consequential incident or accident, including collisions or misuse of the vehicle, the member will be responsible to make all cost good, viz. incurred in any manner to bring the car at the condition provided to member at the beginning of booking. Additionally, the member will be obligated to pay for repair costs.
2. The member will be responsible for all towing and impounding charges incurred as a result of a collision caused by member failure.
3. Zeta will assume responsibility for all towing and impounding charges that arise from vehicle failure.
4. The member will be liable for all applicable damages and costs, including those exceeding the applicable Damage Fee, resulting from the member’s failure to comply with the terms of the Agreement and/or a violation of the law.
Responsibility for Payment:
Please take note of the following important information regarding payments and fees:
1. Members are required to make payments using their credit card, debit card, or other electronic means. It is the member’s responsibility to ensure that the account used for payment has sufficient funds or credit available to cover any charges. The member will be solely responsible for any associated bank or credit card charges or fees. Please be aware that a processing fee maybe charged for declined credit or debit card payments.
2. In the unfortunate event that a member defaults on any payments, Zeta is entitled to charge reminder fees and default interest as allowed by law. Additionally, Zeta may engage third parties to collect any amounts owed by a member.
3. In regards to all aforementioned fees, Zeta reserves the right to prevent a member from making any subsequent reservations until all outstanding fees in the member’s account have been fully paid. If a fee is incurred, members will receive an email invoice from Zeta containing detailed payment instructions.
Eligibility
To ensure a safe and seamless experience, please take note of the following requirements:
1. Members must be 18 years of age or older.
2. Members must possess a valid Light Motor Vehicle (Non Transport) Indian license and provide supporting documents such as Aadhar card/PAN Card/Voter ID Card.
3. Members must have a clean driving record with no alcohol or drug-related driving violations in the past five years.
4. Payments can be made using credit card, debit card, net banking, or UPI.
5. There is no minimum duration of holding a license before becoming a member or reserving a Zeta vehicle, but vehicle will not be provided on Learner’s license.
Platform Term and Use
User Rental Agreement
This document serves as an electronic contract under the Information Technology Act, 2000 and its amended provisions regarding electronic documents and records. It does not require any physical, electronic, or digital signature.
By accepting this document, either directly or indirectly through electronic means, you are entering into a legally binding agreement. This agreement governs the terms and conditions for availing Zeta Rentals and using the services provided through our website (www.zetacartech.com) and mobile application listed over IOS and Android.
We kindly request you to carefully read these terms and conditions before using our website, registering, accessing any material or information, or availing any services through the website. If you do not agree with these terms, please refrain from using the website or availing any Zeta Rentals or services offered through it.
We aim to provide a user-friendly and legally compliant experience.
ZETA USER AGREEMENT
We are pleased to provide you with our vehicle booking and incidental services through our Website/Application. This User Agreement, also referred to as the Agreement, governs the terms and conditions of our services.
Zeta India Private Limited, a company incorporated under the Companies Act 2013, is the entity responsible for this Agreement. Our registered office is located at 2017, MK Tower, Near Bhagat Singh Chowk, Rewari Rd, Dharuhera, Haryana, India, 123106. Throughout this Agreement, “Zeta,” “Company,” “We,” “Us,” or “Our” refers to Zeta India Private Limited,
including its successors, liquidators, and assigns.
As a valued user of our Website, you may be a guest or registered user, whether a natural or legal person. We refer to you as the “User,” “You,” “Member,” “Your,” or “Yourself.” Please note that under the terms of this Agreement, the User has the option to add a co-driver, who will be considered a User and must adhere to the terms and conditions outlined in this Agreement.
1. General:
Please note that this Website/Application is intended for individuals seeking information about the company, its terms and conditions, services offered, and any assistance required for renting/hiring a vehicle. By using the Website/Application and availing services from Zeta, you agree to be bound by this Agreement, along with any other applicable policies incorporated herein by reference. When using or transacting on the Website, you are subject to the relevant policies applicable at that time.
Please be aware that we reserve the right to change or modify the terms of this User Agreement at our discretion. Any updated terms and conditions will be effective from the date of publication on the Website or mobile application. It is your responsibility to regularly check for any changes to the Agreement. If we require your consent to the updated Agreement, you will be notified accordingly. Failure to provide consent and continued use of the Website/mobile application will be deemed as acceptance of the changes. If you do not agree with the changes, you may discontinue your trips/bookings or services under this Agreement.
In case of any conflict between this Agreement and any other document pertaining to Zeta’s othernprograms, these terms and conditions shall prevail, unless otherwise stated by Zeta in writing.
2. Definitions:
2.1 Unless the context or meaning thereof otherwise requires, the following expressions shall have the meanings assigned to them hereunder:
“ Excess Kilometre ” driven shall include any additional Kilometre(s) (“ KM ”) driven on the
Vehicle booked by the User beyond the KMs which were reserved and paid to Zeta by the user. The User shall be liable to pay the additional cost for driving the Vehicle beyond the KMs approved and paid as per the Fee Policy of the Company.
“ In-Vehicle Devices ” means and includes the various devices selected by Zeta to be installed in the Vehicle for the security, safety, tracking and health monitoring of the Vehicle.
“ MV Act ” means the Motor Vehicles Act, 1988 along with the rules prescribed thereunder and includes any statutory modifications or re-enactments thereof and the applicable provisions, if any, of the Motor Vehicles Act, 1988 as amended, modified and re-enacted from time to time.
“ Booking Period ” means the specific period for which the User has made the Booking for usage against the Booking fees, pursuant to terms of this Agreement.
“ Vehicle ” means the self-drive vehicle with or without chauffer on the Website for rent/ hire, which is reserved by the User for a specific period, as per the terms of this Agreement.
“ Commercial and Operating Terms ” shall mean the terms and conditions updated, altered, modified, novated, substituted or replaced from time to time, on which the Vehicle would be operating on the Website, as more particularly exhibited at https://zetacars.in. The User agrees to abide by and shall ensure compliance with all the provisions contained in Commercial and Operating Terms.
3. Vehicle Rental
3.1: Users with a valid driving license can rent self-drive vehicles through our Website/Application for personal use, subject to the terms and conditions of this Agreement, the Fee Policy, and other relevant policies on the Website/Application. This service is known as “Zeta Rental.” To access these services, Users must complete the registration process.
3.2: Zeta reserves the right to allow only Users with a valid and company-approved driving license to drive the allocated vehicle for a specific period, as booked and paid by the User.
4. Vehicle Ownership
4.1 It is important to note that you are not the purchaser or owner of the vehicle at any time or for any purposes, including regulatory requirements under applicable law. The purchase invoice ,Registration Certificate, and all other related documents pertaining to the vehicle will bear the name of the vehicle owner. Only the owner of the vehicle has the exclusive rights to transfer any right, interest, or title associated with the vehicle, such as pledge, hypothecation, charge, lien, or sale.
4.2 Users acknowledge and agree that they are not the owners of any vehicle, and neither they nor any authorized person, legal heirs, representatives, etc., are entitled to claim depreciation on the vehicle for tax or any other purposes.
4.3 Offline Transactions: It is strictly prohibited to engage with vehicle owners for the purpose of renting or hiring a car outside of the Website/Application. Zeta shall not be responsible or liable for any offline transactions conducted by you.
5. Booking Zeta Vehicles
5.1 The User acknowledges that making a reservation is a fundamental requirement for all
prospective Bookings. To reserve a vehicle in advance, the User should follow the steps on the application (Website) and will be charged usage fees at the time of reservation. The general steps for reserving a Vehicle on the application (Website) include:
(i) Select the desired region/area where the vehicle is needed.
(ii) Specify the start and end date and time, indicating the duration of the Booking Period.
(iii) Choose a vehicle that suits your needs.
(iv) Make the necessary Booking payment through Zeta’s accepted payment systems at that time.
5.2 The User has the flexibility to either pick up/drop off the Vehicle at a designated location or opt for Zeta’s delivery service to the preferred location.
5.3 Following the reservation of the Vehicle, Zeta will, at its discretion and subject to vehicle availability, confirm the reservation and provide the User with details of the final Booking (“Booking”).
5.4 The handover of the Vehicle for the initial Booking, any extensions, and modifications is contingent on vehicle availability. Zeta reserves the right to cancel a Booking if the Vehicle is unavailable.
5.5 At the time of taking possession of the Vehicle, the User must fulfill the following conditions:
(i) Present their original driving license, which was provided during the account setup with Zeta Rental.
(ii) Provide the original documents and assist Zeta’s representative in capturing an image of one of the following documents as additional ID proof to be kept on record: (a) Voter ID; (b) Aadhar card; or (c) Valid Passport.
(iii) Cooperate with Zeta’s representatives to take a photograph of the Vehicle along with the User for safety and record-keeping.
(iv) Complete and submit the Vehicle checklist at the beginning and end of the trip. Failure to meet these conditions at the time of taking possession of the Vehicle grants Zeta the right to withhold possession, resulting in the cancellation of Zeta Rental, with no obligation to refund the security deposit and Booking fee. Additionally, if the User takes possession without meeting these conditions, they assume sole responsibility for any resulting liabilities or losses.
5.6 Only a registered user on the application (Website) who has provided a valid driving license and the required documents may obtain a Zeta Rental. The registered User’s details and the know-your-customer documents must match. Notably, if a person is not registered on the application (Website) or the Driving License does not belong to the same person, a Zeta Rental cannot be obtained by any other registered user on their behalf.
5.7 Cancellation/Reduction of Booking Period: To cancel a reservation/Booking or reduce the Booking Period, you must adhere to the Fee Policy. Additionally, if the User fails to pick up the vehicle within 3 hours of the start of the Booking, the Booking will be automatically cancelled.
5.8 Extension of Zeta Rental: To extend a Zeta Rental, the following conditions must be met:
(i) Online payment for the extension has been made and received by Zeta.
(ii) The Vehicle is available for the extension period (i.e., not reserved by another User).
(iii) The extension request is submitted before the scheduled expiration time of your existing Zeta Rental.
Please note that it is your responsibility to return the vehicle to the designated drop-off location provided during the booking process. Failure to meet these conditions after the booking period has expired will be considered unauthorized possession of the vehicle. You must promptly hand over the vehicle to Zeta’s parking or its representative without delay.
Any delay exceeding one hour from the expected handover time or after the booking period will result in you being held liable for wrongfully detaining the vehicle, theft, and breach of trust. Your involvement in the theft of the vehicle will be presumed without any doubt.
In such an event, we reserve the right to initiate criminal proceedings against you and make all reasonable efforts to take possession of the vehicle from you, immediately or at any time thereafter, and at any location. Please be aware that if you fail to hand over the vehicle as required:
(i) You will be charged late fees, inconvenience fees, and any other applicable charges as per our Fee Policy from the scheduled end time of your Zeta Rental until the vehicle is recovered by us.
(ii) You will be held responsible for additional costs incurred by us in taking possession of the vehicle, including legal attorney fees, consultant fees, travel costs, etc.
(iii) You will not receive any compensation or alternative means of transportation, and you will be blacklisted from using our vehicles in the future.
You agree to hold Zeta, its officers, employees, agents, and affiliates harmless against any claims related to the vehicle and/or its repossession. Furthermore, you agree to irrevocably and unconditionally indemnify Zeta against any costs, losses, or liabilities suffered by Zeta arising from any third-party claims in relation to the vehicle and/or its repossession.
