6. Vehicle Pick-Up and Return/Vehicle Condition/Stolen Vehicles
6.1 You are responsible for collecting the reserved vehicle from the designated parking space and returning it in a secure, clean, and operational condition to the designated parking space by the end of the booking period. The availability of the vehicle for handover is subject to availability. Additionally, we retain the right to cancel any booking at our sole discretion, with the only consequence being the return of the fees collected at the time of booking creation.
6.2 Prior to taking possession of a vehicle, it is your responsibility to conduct a thorough
inspection of both the exterior and interior. Before commencing a Zeta Rental, you must promptly inform Zeta of any damage or abnormality observed on the vehicle or during its
operation. Failure to report any issues at the beginning of the booking will result in you beingheld responsible for any problems discovered or reported after the completion of your booking, including but not limited to vehicle damage or lack of cleanliness. In such cases, you may be subject to a damage fee, cleaning fee, or other applicable charges, and Zeta reserves the right to suspend or terminate your Zeta Rental.
6.3 Upon the conclusion of your Zeta Rental, you are required to leave all original documents, including but not limited to the registration certificate, insurance policy, tax payment challans self-drive licenses, pollution clearance certificates, vehicle’s key, key fob, or any other starting device in their designated position within the vehicle. If you fail to do so, it is imperative that you immediately inform Zeta. In the event that this failure causes inconvenience to Zeta or another user or customer, you will be charged the hourly rates for the vehicle until the original documents, key/RC/toll payment pass (if applicable) are safely returned to Zeta. You will also be held responsible for the payment of charges incurred during this period. Additionally, Zeta reserves the right to charge an inconvenience fee at its sole discretion if any of the aforementioned items/documents are lost and require replacement.
6.4 The conclusion of the trip will be confirmed through either
(i) the completion of a closing checklist at the end of the trip; or
(ii) sending an SMS message to the designated number provided by Zeta to notify them of your intent to end the trip; or
(iii) in the event of an unforeseen breakdown or accident involving the vehicle.
6.5 As the user, you are responsible for all charges and costs associated with the vehicle throughout the duration of the Zeta Rental, until the vehicle is returned in a secure, closed, and serviceable condition to its designated location. This includes ensuring that all accessories are turned off, the key is removed from the ignition and placed in its proper position, all windows, doors, hatches, sunroofs, and other openings are closed, and the toll payment pass and other accessories are left in the vehicle. The vehicle must be returned at the end of the Booking Period, and any extension will be subject to the provisions outlined in Clause 6.4.
6.6 User is required to immediately report to us any condition that impairs the driving functionality of the Vehicle, such as poor driving feel or external or internal damage that renders the Vehicle unsafe, including but not limited to, missing or inoperable signal or driving lighting, broken or missing rear-view mirrors and windshield glass.
6.7 Any damage caused to the vehicle due to your deliberate misconduct or gross negligence, or in the event of theft, whether the vehicle is in motion or not, will result in charges or fees at our sole discretion.
6.8 It is your responsibility to collect the selected vehicle and return it in a secure, clean, and fully functional condition to the designated drop-off location provided by Zeta no later than the end time of the Booking Period.
6.9 In the event of a stolen vehicle or any accidental incidents, it is imperative that you immediately report the incident to us and the nearest police station, providing a detailed written complaint based on accurate facts. It is essential that such complaints do not contain any discrepancies, inconsistencies, or distortions from the actual facts, as this may adversely affect any valid insurance or other claims made by us. You will be solely liable for any losses incurred by us due to any discrepancies, inconsistencies, or distorted information provided in the complaint. It is your sole responsibility to ensure that proper police and judicial procedures are followed in relation to such incidents.
7. Obligations of / Use of Vehicle by the User
7.1 By accepting these Terms, the User grants Zeta authorization to obtain their driving records from the licensing jurisdiction.
7.2 The User may use the Vehicle for personal use without any additional charges, except for the Booking fees and any other dues owed to Zeta under this Agreement and related policies. The User acknowledges that We shall not be liable for any claims arising from their use of the Vehicle.
7.3 The User is responsible for providing and maintaining accurate account information with Zeta, including email, mobile number, address, and other necessary details for the purposes of this agreement.
7.4 The User is responsible for maintaining the confidentiality of any Zeta-related passwords and/or PIN numbers and must not share them with third parties. If a password or PIN is written or stored electronically, the User will be held accountable for any costs or damages resulting from unauthorized use by third parties. In the event of suspected unauthorized access to a password or PIN, the User agrees to promptly change the compromised password and/or PIN following the procedure outlined on the Website.
7.5 When using a Vehicle, the User must adhere to the instructions provided in the owner’s manual. If any issues arise that hinder or pose a safety risk during the use of the Vehicle, the User must immediately inform Zeta and follow the instructions provided by Zeta.
7.6 The User shall provide all the documents and assistance, as may be required to obtain applicable licenses, and permits for Booking the Vehicle through the Website and use thereof, in accordance with the terms of this Agreement and the Commercial and Operating Terms.
7.7 On expiry or earlier termination of this Agreement, the User shall handover the Vehicle, to Zeta in reasonable commercial condition, save and except reasonable/actual damage or normal wear and tear caused to the Vehicle during the usage of Vehicle by the User.
7.8 Zeta reserves the absolute right to install the In-Vehicle Devices at the cost of the Company. The User hereby unconditionally agrees not to tamper or remove such In-Vehicle Devices. The User agrees and acknowledges that such installed devices may require minor modification from time to time and the User shall provide full access of the Vehicle to Zeta or any other party appointed by Zeta for the purpose of modification of such devices. In case the User removes or otherwise tamper the devices, the User shall be liable to pay Zeta the actual cost of the device. Zeta further reserves the right to deduct the foregoing amount from any credit/bonus to be paid by Zeta to Users.
8. Persons Permitted to Drive
8.1 Only active Users in good standing, as determined by Zeta, are permitted to drive the Vehicle. Non-Users are strictly prohibited from driving the Vehicle. A User with a valid driving license (uploaded/provided and approved by Zeta) may drive a Vehicle reserved by another User with their permission. However, all fees and charges will be the responsibility of the reserving User, and any liability or claim arising from such usage will be shared among all participants. The User making the Booking must ensure that any other person with a valid driving license drives the Vehicle only with prior consent from Zeta. Failure to comply will result in the User being solely liable to indemnify Zeta for any losses incurred.
8.2 Meeting the eligibility criteria to become a User does not guarantee automatic acceptance. Approval of the applicant’s Zeta Rental is at the sole discretion of Zeta.
8.3 In pursuance of Zeta Rental services, every applicant hereby grants Zeta the irrevocable
authorization, and Zeta retains the exclusive prerogative to procure the driving records of the applicant from the jurisdiction where their driving license is issued. As the operation of a Vehicle necessitates maintaining an unblemished driving history, Zeta reserves the right to periodically assess the driving records of its Users. Furthermore, Zeta, at its sole discretion, maintains the right to suspend or terminate the Zeta Rental privileges of any User who fails to meet the driving eligibility criteria set forth by Zeta.
8.4 The User, in compliance with these terms, commits to promptly notify Zeta in the event of their driving license’s expiration, suspension, or revocation. This obligation extends to reporting any tickets, citations, or convictions pertaining to traffic violations, including but not limited to offenses such as driving under the influence of drugs or alcohol, driving while intoxicated, reckless driving, exceeding the speed limit, or engaging in activities such as sending SMS while operating a vehicle. In the unfortunate event of a User’s driving license expiring or being revoked, their authorization to operate a Zeta Vehicle shall instantaneously cease.
It is imperative for all Zeta Rental Users to fully comprehend and adhere to these driving-related stipulations, as failure to do so may result in the suspension or termination of their access to Zeta Rental services. Your safety and the safety of others on the road remain our paramount concern.
8.5 The User is responsible for keeping their email, cell phone, residential address
(current/temporary and permanent), and other account information up to date with Zeta. The User guarantees that the information provided to Zeta is accurate and agrees to promptly notify Zeta of any changes, including but not limited to their residential address.
9. Prohibited Uses
Prohibited Vehicle Use Conditions:
Engaging in any speed race or competition is strictly forbidden.
Towing, pushing, or propelling trailers or other vehicles with our Vehicles are prohibited.
Using the vehicle primarily for transporting passengers or operating as a taxi service is not allowed.
Operating a vehicle while under the influence of alcohol, drugs, or any medication that impairs safe driving is strictly prohibited. We adhere to a zero-tolerance policy.
Using the vehicle for any criminal or illegal activities is strictly prohibited.
Operating the vehicle in an imprudent, negligent, or abusive manner, or for any abnormal use, is not allowed.
Providing false information to Zeta, including incorrect name, age, or address, is a violation of our terms.
Driving a vehicle outside of India or in prohibited areas within India is not permitted.
Using a mobile phone or any other communication device while driving, which may distract you from safe driving or violate applicable laws, is strictly prohibited.
Transporting flammable, poisonous, or hazardous substances for purposes other than legally permissible household use, or in excessive quantities, is not allowed.
Transporting objects that could affect the vehicle’s handling safety, damage the interior, or pose a safety risk to other vehicles due to their size, shape, or weight is prohibited.
Burning any substances, including tobacco and incense, inside the vehicle is absolutely prohibited.
Animals are not allowed in the vehicles, unless they are designated as “pet friendly.” Users will be subject to penalties for using non-pet-friendly vehicles for animal transportation.
Exceeding the prescribed seating capacity established by the vehicle manufacturer is not permitted.
Engaging in any activity that could disrupt the normal conditions of the vehicle is strictly prohibited.
Please adhere to these guidelines to ensure safe and lawful use of our vehicles.
9.2 Unacceptable Use and Consequences:
We want to emphasize that the examples provided earlier are not an exhaustive list. Any use of the vehicle that is deemed unreasonable, unwarranted, illegal, unethical, or inappropriate, except for personal travel, at the sole discretion of Zeta, constitutes a violation of our terms and conditions.
Zeta reserves the right to report any violations, whether they involve vehicle use or other activities, to the relevant authorities if they contravene local, state, or national laws or breach these terms and conditions.
9.3 Suspension and Termination:
In the event of a breach of any terms and conditions of the Agreement, Zeta retains the right to immediately suspend or terminate a User’s access to our service. Zeta may also choose to cancel any existing bookings made by the User, at its sole discretion.
Furthermore, the User will be held fully accountable for any and all losses, damages (whether direct or indirect), costs, charges, fees, and expenses incurred by Zeta as a result of the breach of these terms and conditions. The User unequivocally and irrevocably consents to Zeta’s right to take remedial action to recover these losses and damages, which may include pursuing claims against the User’s property, as well as their legal heirs or representatives’ properties.
10. Safety
User Responsibilities:
10.1 Compliance with Laws: It is imperative that the User complies with all relevant laws,
including seat belt, speed limits, and child restraint laws. Users must also adhere to maximum speed and weight limits and any instructions provided by authorities through road signs and markings.
10.2 Child Safety: Ensuring the safety of all children in the vehicle is the User’s responsibility. This includes the proper use of child passenger restraint systems that meet the safety standards in the respective jurisdiction.
10.3 Vehicle Security: Each time the User parks a vehicle, whether at the end of the booking or during the booking, they must take responsibility for securing the vehicle. This includes closing windows and manually locking the car.
